RECONHECIMENTO DE VÍNCULO EMPREGATÍCIO ENTRE TRABALHADORES E APLICATIVOS

The aim of this research is to investigate the relationship between workers and digital platforms. The intrinsic existing relationship is a triggering event for a possible employment relationship and, therefore, the following legal requirements that generate this relationship will be analyzed and compared: natural person, personality, subordination, onerosity and non-eventuality. The failure to comply with employment
relationship creates a burden on the disadvantaged party in this legal relationship and affronts the Constitution since it suppresses fundamental rights and guiding principles of Labor Justice.
